Here in Atlanta, Georgia, Old Man Winter is beginning to blow the first frigid winds of the season. Low temperatures are expected to dip below freezing this weekend. As winter weather approaches, Georgia residents should be aware of the potential for slip and fall injuries on icy surfaces.
Ice may form wherever water gathers, but some premises have an especially high risk for slips and falls on ice. In 2006, for instance, a plaintiff in Virginia settled a slip and fall case against a car wash for $100,000. The plaintiff slipped and fell on a patch of ice that had formed from runoff water and argued that the proprietor of the car wash had knowledge of the ice and ample time to clear it.
Slip, trip and fall injuries lead to thousands of lawsuits and millions of dollars in claim costs each year. Some businesses -- such as car washes, grocery stores, and restaurants -- are more likely to be defendants in slip and fall lawsuits due to the propensity for water runoff, spills, and slippery floors.
In fact, the car wash industry takes slip and fall injuries so seriously that the Southeast Car Wash Association is presenting a "Slips, Trips, and Falls" webinar on November 17. The webinar is aimed at car wash operators who want to prevent slip and fall injuries at their place of business. Scheduled presenters include Mike Benmosche of Mang Insurance, CNA's Small Business Risk Control Director Bob Mellendick, and CNA's General and Products Liability Risk Control Director David Ludwin. Car wash locations often have slippery surfaces, even when there's no ice, and car wash operators have a duty to protect customers from slip and fall injury hazards.
